Terms of Service
The agreement that governs your use of Fan Club Pro.
Last updated: September 28, 2026
These Terms of Service (the "Terms") are a binding agreement between you and Fan Club Pro, Inc. ("Fan Club Pro", "we", "us", or "our") and govern your access to and use of the Fan Club Pro website, applications, embeddable widgets, and related services (together, the "Platform"). By creating an account, joining a club, embedding our widget, or otherwise using the Platform, you agree to these Terms. If you do not agree, do not use the Platform.
Fan Club Pro is a membership platform for artists and creators. Artists, creators, and their teams ("Creators") run fan clubs where fans ("Members") buy paid memberships that unlock exclusive content, community, events, and perks. Some provisions below apply to everyone, and some apply specifically to Creators or to Members.
Fan Club Pro is a software platform, not the seller. For every membership sale, the Creator is the seller and merchant of record. Members pay the Creator directly through the Creator's own Stripe account; Fan Club Pro never holds or controls Member funds. Fan Club Pro provides the software and charges the Creator a flat monthly subscription for each club (or, for enterprise Creators, custom negotiated terms, which may include a percentage of membership revenue). The Creator sets the price, what each plan includes, and the refund terms for its own club (see that club's membership terms).

1. Eligibility and accounts
You must be at least 13 years old to use the Platform, or the higher minimum age (14, 15, or 16) that applies where you live under local law (for example, in parts of the European Economic Area). Signup shows the minimum age that applies to you, and you confirm it when you accept these Terms. If you are under the age of majority where you live, you may only use the Platform with the involvement of a parent or guardian who agrees to these Terms. Creators must be old enough to form a binding contract and must have authority to bind the artist, label, or business they represent.
Accounts are passwordless. We sign you in with a secure, one-time link or code sent to your email, or through a supported single sign-on provider such as Google, and you can add optional protections such as passkeys or an authenticator app. Keeping access to your email account secure is your responsibility. Member accounts and Creator accounts are separate accounts, even if they use the same email address. You agree to provide accurate information, to keep it current, and to be responsible for all activity that occurs under your account. Notify us promptly at club@fanclubpro.com if you suspect unauthorized use.
2. Creator responsibilities
If you use the Platform as a Creator, you additionally agree that:
- You own or have the rights to the artist name, branding, and content you publish, and your use of the Platform will not infringe anyone's rights.
- You are the seller and merchant of record for your memberships. You set your plans, prices, and what each plan includes, and you are responsible for delivering the content, access, and perks you promise to your Members.
- You must connect your own Stripe account to accept memberships, and your use of Stripe is governed by Stripe's terms. You are responsible for Stripe's payment-processing fees on your membership sales, and for any taxes, subscription-billing disclosures, auto-renewal notices, and consumer-protection requirements that apply to your memberships and promotions.
- You will publish clear membership terms and a refund policy for your club, and you will honor them. Fan Club Pro provides neutral default terms you can edit; your club-level terms govern your relationship with your Members.
- You are the controller of your fans' personal data that you collect through your club. You will handle that data lawfully, provide any required notices, honor fan requests and choices, and comply with applicable privacy and marketing laws. Our role in handling that data is described in our Privacy Policy.
- You will not use the Platform for unlawful activity, spam, or anything that violates the terms of the third-party platforms you connect.
3. Member terms
If you use the Platform as a Member, you agree that:
- One free Fan Club Pro account works across every club. Each membership is separate: you join, pay for, and manage each club's membership on its own.
- A paid membership unlocks the content, community, events, and perks the Creator offers for the plan you choose. What is included is set by the Creator and shown on the club's page before you join.
- Your access depends on an active membership. If your membership lapses, is cancelled, or is refunded, your access to members-only areas ends.
- Some perks or events require you to provide additional information, such as a shipping or contact detail. You are responsible for providing accurate information.
4. Memberships, payments, and refunds
Memberships are paid subscriptions sold by the Creator, not by Fan Club Pro. When you join, you authorize the Creator (through Stripe) to charge the plan price shown plus any applicable taxes, and, for recurring plans, to charge it each billing period until you cancel. You can cancel at any time from your account in the club, and cancellation takes effect at the end of the current billing period. You keep access until then. If a membership payment is fully refunded, the access it paid for is revoked.
Because the Creator is the seller and merchant of record, refunds, price changes, and what each plan includes are set by the Creator and governed by that club's own membership and refund terms. Fan Club Pro is not responsible for a Creator's content, for the value or quality of a membership, or for disputes between a Member and a Creator. If a Creator closes its club or leaves the Platform, active memberships may be cancelled and access may end. If you are a consumer in the EU, EEA, or United Kingdom, see our Right of Withdrawal page for your 14-day withdrawal right. Nothing here limits any non-waivable consumer rights you have under applicable law.
5. Your content and license
"Your Content" means anything you submit to the Platform, including profile details, images, community posts, comments, and messages. You keep all rights you already have in Your Content. You grant Fan Club Pro a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit Your Content solely as needed to operate, secure, and improve the Platform and to provide the features you use (for example, displaying your community post to a club).
You are responsible for Your Content and represent that you have the rights to share it and that it does not violate these Terms or any law. We may remove content that we reasonably believe violates these Terms or that a Creator removes from their club. Copyright complaints are handled under our Copyright & DMCA Policy, and in appropriate circumstances we terminate the accounts of repeat infringers.
6. Acceptable use
You agree not to:
- Break the law, infringe intellectual property, or violate anyone's privacy or publicity rights.
- Upload malware, attempt to breach security, probe or scan the Platform, or circumvent rate limits, authentication, or access controls.
- Share, resell, or redistribute members-only content, or circumvent the membership paywall or access controls.
- Harass, threaten, impersonate, or post content that is hateful, sexually exploitative, or otherwise abusive.
- Scrape, resell, or use the Platform or its data other than as permitted, or use it to build a competing service.
- Interfere with the Platform's operation or the experience of other users.
Zero tolerance for objectionable content and abusive users. There is no tolerance for objectionable content or abusive behaviour anywhere on the Platform. Every place members can post (community posts, comments, and live chat) lets you report the content and block the member from the item itself, and Creators may hold posts for approval before they appear. We review reports of objectionable content and act on them within 24 hours by removing the content and, where warranted, ejecting the member who posted it. You can reach us any time through our Contact page.
Zero tolerance for objectionable content and abusive users. There is no tolerance for objectionable content or abusive behaviour anywhere on the Platform. Every place members can post (community posts, comments, and live chat) lets you report content and block another member from the item itself, and clubs may hold posts for approval before they appear. We review reports of objectionable content and act on them within 24 hours by removing the content and, where warranted, ejecting the member who posted it. 7. Creator plans and billing
Member accounts are free to create; memberships are paid to the Creator as described above. As a Creator, you pay Fan Club Pro a flat monthly subscription for each club you run. By creating a club and completing checkout you agree to this Section 7, and you authorize us (through our payment processor, Stripe) to charge the payment method on your account for each club's subscription each billing period until you cancel. If your club is billed through Shopify, the paragraph headed "Clubs billed through Shopify" below replaces that authorization and overrides anything in this Section 7 that conflicts with it.
Clubs billed through Shopify. If you connect a Shopify store to a club, that club's Fan Club Pro subscription is billed by Shopify instead of by us, and it appears on your Shopify invoice under Shopify's own billing terms. We do not charge a payment method for that club. Four things work differently for a club billed this way:
- You choose and approve the plan in Shopify. Plan changes are started in the Fan Club Pro app inside your Shopify admin and take effect only once you approve the charge on Shopify's confirmation screen. Your Fan Club Pro dashboard shows the plan but cannot change it.
- Plans are never upgraded automatically. Because a price change needs your approval, we cannot move the club to a larger plan for you. Instead, when the club reaches its plan's paying member limit, new paying Members cannot join until you approve a larger plan. Everyone already in the club keeps full access. We tell you by email before you reach the limit and again when you hit it.
- Downgrading and cancelling happen in Shopify. Cancelling the Shopify subscription, or uninstalling the app, ends the club's paid plan.
- If Shopify reports the subscription unpaid or cancelled, the club keeps its current plan for a short grace period (currently 7 days) while you fix it, and we email you. After that the club moves to the Free plan's limits. Nothing is deleted and no existing Member loses access; the club simply stops accepting new paying Members beyond the Free limit.
Memberships your fans buy are not affected by any of this: they are paid to you through your own Stripe account, as described above, and never through Shopify.
Plan tiers and automatic upgrades. Club plans are sized by the number of active paying members in that club, in the bands published on our pricing page at the time of billing. When your club's active paying membership exceeds its plan's band, the club is upgraded to the next plan automatically: the larger plan's features unlock immediately, and the new plan's price applies from your next invoice. Nothing extra is charged mid-cycle and charges are never prorated. You expressly authorize these automatic plan upgrades and the corresponding recurring charges. They are how your club keeps accepting new members without interruption, and your Members' access is never affected by a plan change. Plans never move down automatically: you may downgrade from your dashboard whenever your active paying membership fits the smaller plan's band, effective at your next invoice, and the downgrade removes the larger plan's features as described in the product at the time you confirm it. Clubs above the largest published band continue on the largest plan until enterprise terms are agreed.
Club activation. A newly created club is not visible to Members until its first subscription payment completes. Enterprise Creators may operate under custom negotiated terms (including a flat monthly amount or a percentage of membership revenue) which replace the published tiers for the clubs they cover.
Failed payments and recovery. If a club subscription payment fails, we retry it. While it remains unpaid, editing access to your dashboard is suspended; your clubs, your content, and your Members' access are not affected. If payment still cannot be collected, you authorize us to recover the unpaid balance by applying a recovery fee to membership payments processed through your connected Stripe account (up to 100% of each payment) until the amount you owe has been collected. We never keep more than the amount you owe: if a collection exceeds the remaining balance, the excess is refunded to you. Once the balance is settled, the recovery fee is removed and full access is restored automatically. We may suspend or terminate accounts with a continued unpaid balance.
General. Subscriptions renew automatically until cancelled. You can cancel a club's subscription at any time from your dashboard; cancellation takes effect at the end of the current billing period, after which the club's dashboard becomes read-only while your Members keep their access, and you remain responsible for your obligations to your Members. Fees are stated exclusive of taxes and are non-refundable except where required by law. Email top-up credits are one-time purchases that do not expire and are non-refundable. We may change plan pricing, bands, or features on reasonable notice; changes apply from your next billing cycle.
8. Third-party services
The Platform relies on and can connect to third-party services, including Stripe for payments and Shopify for store perks, and relies on infrastructure providers to operate. Your use of a connected third-party service is governed by that provider's own terms and privacy policy, and we are not responsible for third-party services. Connecting a service (for example, a Stripe account or a Shopify store) means you authorize the exchange of data needed for the integration to work.
9. Intellectual property
The Platform, including its software, design, and the Fan Club Pro name and logo, is owned by us and our licensors and is protected by intellectual property laws. These Terms do not grant you any rights in the Platform other than the limited right to use it as described here. Feedback you send us is voluntary, and we may use it without obligation to you.
10. Suspension and termination
You may stop using the Platform and delete your account at any time. Self-serve deletion uses a 30-day grace window: your account is deactivated immediately, signing back in during the window restores it, and after the window the associated data is purged as described in our Privacy Policy. Deleting a club cancels its Members' paid subscriptions, effective at the end of each Member's current billing period, and we notify those Members. We may suspend or terminate your access if you violate these Terms, if we are required to by law, or to protect the Platform or its users. We may also discontinue features or the Platform on reasonable notice. Provisions that by their nature should survive termination will survive, including sections on content licenses, disclaimers, liability limits, and indemnification.
11. Disclaimers
The Platform is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or secure, or that any membership content will be delivered. Some jurisdictions do not allow the exclusion of certain warranties, so some of these exclusions may not apply to you.
12. Limitation of liability
To the maximum extent permitted by law, Fan Club Pro and its affiliates, officers, directors, employees, agents, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising from or related to your use of (or inability to use) the Platform, whether the claim is based on contract, tort, or any other legal theory, and even if we have been advised of the possibility of such damages. Our total liability for any claim relating to the Platform will not exceed the greater of the amounts you paid us in the twelve months before the claim, or one hundred U.S. dollars (USD 100). Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
13. Indemnification
You agree to defend, indemnify, and hold harmless Fan Club Pro from claims, damages, and expenses (including reasonable legal fees) arising from Your Content, your memberships or club, your breach of these Terms, or your violation of any law or the rights of a third party.
14. Governing law and disputes
These Terms are governed by the laws of the State of New Hampshire, United States, without regard to its conflict-of-laws rules, and the federal or state courts located in New Hampshire will have jurisdiction, unless applicable law in your place of residence requires otherwise. You and Fan Club Pro agree to first try to resolve any dispute informally by contacting club@fanclubpro.com. Nothing in these Terms limits any rights you have as a consumer that cannot be waived under applicable law.
15. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, notify you. Your continued use of the Platform after changes take effect means you accept the updated Terms.
