Filing an infringement notice
If you believe content hosted on Fan Club Pro infringes a copyright you own or control, send a written notice to our designated agent at ricky@fanclubpro.com with the subject line "DMCA notice". Under 17 U.S.C. §512(c)(3), for your notice to be effective it must include:
- Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are covered).
- Identification of the infringing material and information reasonably sufficient for us to locate it (the club page URL and a description of where on the page it appears).
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.
- Your physical or electronic signature.
Please note that under 17 U.S.C. §512(f), you may be liable for damages if you knowingly and materially misrepresent that content is infringing, or that it was removed or disabled by mistake or misidentification.
What happens next
On receipt of a complete notice we will remove or disable access to the identified material promptly, notify the creator or member who posted it, and provide them a copy of the notice. We keep records of notices, and in appropriate circumstances we terminate the accounts of users who are repeat infringers.
Counter-notices
If your content was removed and you believe the removal was a mistake or misidentification, you may send a counter-notice under 17 U.S.C. §512(g) to the same address with the subject line "DMCA counter-notice", including: identification of the removed material and where it appeared before it was removed, your name, address, and telephone number, a statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification, a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which Fan Club Pro may be found) and that you will accept service of process from the person who filed the original notice or their agent, and your physical or electronic signature. If we receive a valid counter-notice we will promptly forward it to the original complainant, and we may restore the material no sooner than 10 and no later than 14 business days after receiving the counter-notice, unless the complainant first notifies us that it has filed a court action seeking to restrain the alleged infringement.
